Terms governing access to and use of FonProxy services.

1. Agreement
These Terms and Conditions govern access to and use of our website, dashboard, APIs, proxy products, residential proxies, static IP products, mobile proxy products, and related services.
By creating an account, placing an order, accessing the website, or using any service, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy.
If you do not agree, you must not use the services.
2. Provider
The services are provided by FonProxy (fonproxy.io).
3. Eligibility
You represent that:
- you have legal capacity to enter into this agreement
- all information you provide is accurate
- you will use the services only for lawful and authorized purposes
- you are not prohibited from using the services by applicable law
4. Nature of the Service
We provide proxy-related connectivity products and related account functionality. Availability, speed, routing, country selection, IP consistency, session persistence, or specific endpoints may change at any time due to carrier, supplier, upstream, technical, legal, abuse, or operational reasons.
We do not guarantee uninterrupted availability, error-free operation, availability in every country, or suitability for any particular target website or use case.
5. Acceptable Use
Use of the services must comply with the Acceptable Use Policy. Prohibited uses include attacks, spam, abusive automation, credential abuse, phishing, fraud, malware distribution, unlawful scraping, sanctions evasion, and unauthorized sharing or resale unless expressly permitted by us.
We may determine, in our reasonable discretion, whether conduct creates operational, legal, reputational, payment, abuse, or security risk.
6. Account Security
You are responsible for:
- maintaining confidentiality of credentials
- all activities under your account
- securing your systems and scripts
- preventing unauthorized use
You must notify us immediately of unauthorized access, suspected compromise, or misuse.
7. Orders, Provisioning, and Risk Review
We may accept, reject, delay, limit, cancel, or manually review any order for fraud, abuse, sanctions, payment risk, technical limitations, KYC-related concerns, identity inconsistency, repeated disputes, or other legitimate business reasons.
Activation times are estimates only.
8. Pricing and Payment
Prices, currencies, billing periods, and included traffic are shown at checkout or in your account.
Payments may be processed through monobank, WayForPay, Cryptomus, or related payment/acquiring partners.
You authorize us and our payment partners to:
- charge the amount due
- verify payment details
- place or process holds where supported
- reverse, block, or decline suspicious transactions
- request additional verification where needed
9. No Guarantee of Compatibility
We do not guarantee that any target site, app, platform, marketplace, or third-party service will accept or continue accepting traffic through our proxies.
Third-party blocking, rate limiting, CAPTCHA, fingerprinting, geo-fencing, account bans, or anti-bot responses are outside our control.
10. Logging and Monitoring
For abuse prevention, fraud detection, incident response, support, and enforcement, we keep limited logs for 14 days, including:
- source IP
- outgoing IP
- package
- country
- destination domain or destination IP
Use of the service constitutes acknowledgment of this logging practice.
11. Suspension and Termination
We may, without prior notice, suspend, restrict, or terminate any account, order, session, IP allocation, or access where we reasonably believe that:
- these Terms or the AUP were violated
- a payment dispute or fraud risk exists
- the service is used in a way that harms us, our providers, our IP reputation, or third parties
- continued provision creates legal, operational, or reputational risk
- a government authority, upstream provider, network operator, or substantiated abuse complainant requires investigation or mitigation
In such cases, we may preserve records, cooperate with investigations, and refuse future service.
12. Refund Policy
12.1 General rule
Because proxy services are digital services that may be consumed immediately after activation, all sales are generally final unless otherwise required by applicable law or expressly approved by us.
12.2 Special refund mode for pay-for-usage plans
For usage-based billing products, we may consider a refund only in a special mode, and only if both of the following conditions are met:
- no more than 200 MB of traffic has been used
- no more than 3 calendar days have passed from the billing date
If either threshold is exceeded, the order is considered consumed and normally becomes non-refundable.
12.3 No refund in abuse or policy-violation cases
No refund will be granted if:
- the customer violated these Terms or the AUP
- the account was suspended for abuse, spam, attacks, unauthorized sharing, or unlawful activity
- the customer opened a payment dispute or chargeback without first contacting support and allowing a reasonable internal review
- the issue was caused by the customer's scripts, credentials, targets, local systems, blocked destinations, or misuse
12.4 Abuse appeal
If an order is blocked due to suspected abuse, the customer may contact support and submit an explanation or request a review. We may, at our sole discretion, restore, partially restore, or keep the block in place. A review request does not create any right to a refund.
12.5 Chargebacks and disputes
If a chargeback, bank dispute, or payment reversal is initiated, we may suspend or terminate all related services and accounts while the matter is under review. We may submit transaction records, order data, logs, communication records, and policy documents to the relevant payment processor, acquiring bank, or dispute body.
13. Disclosure in Abuse Cases
If we receive a request, complaint, subpoena, legal demand, law-enforcement request, court order, abuse report, or technically substantiated complaint connected to our IPs or services, we may disclose relevant data, logs, customer identifiers, billing information, and usage evidence to:
- competent authorities
- courts
- payment institutions
- network operators
- affected websites or service providers
- upstream partners
- professional advisers
We may do so where we reasonably believe disclosure is necessary to investigate, prevent, mitigate, or resolve abuse, fraud, security incidents, legal claims, or violations of these Terms.
14. Intellectual Property
All software, branding, website content, dashboards, and service materials belong to us or our licensors unless otherwise stated. No license is granted except the limited right to use the services in accordance with these Terms.
15. Disclaimer
The services are provided on an "as is" and "as available" basis to the fullest extent permitted by law.
We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or results from use of the services.
16. Limitation of Liability
To the fullest extent permitted by law:
- we are not liable for indirect, incidental, special, punitive, or consequential damages
- we are not liable for loss of profits, revenue, data, business, contracts, goodwill, or opportunities
- our total aggregate liability arising out of or related to the services shall not exceed the amount paid by the customer for the affected service during the 30 days preceding the event giving rise to the claim
This limitation applies regardless of the form of action and even if we were advised of possible damages.
17. Indemnity
You agree to defend, indemnify, and hold harmless us, our suppliers, contractors, and partners from claims, losses, liabilities, damages, costs, and expenses arising out of:
- your use of the services
- your content, scripts, or targets
- your breach of these Terms or the AUP
- your violation of law or third-party rights
18. Governing Law and Jurisdiction
These Terms are governed by the laws of Ukraine, except where mandatory consumer laws of another jurisdiction apply and cannot be excluded.
Any dispute shall be subject to the courts of Ukraine, unless mandatory law requires otherwise.
19. Changes
We may amend these Terms at any time by posting an updated version on the website. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
